Republicans point to estimates of one third of all medical procedures are done just to prevent lawsuits. They claim tort reform will eliminate that.
No so! The Republican plan still allows for doctors to be sued for all actual costs and $500,000 in punitive damages. Doctors will still be requiring extra procedures because they are still subject to millions in damages.
In other countries with single payer insurance, the plaintiff has to sue the insurer, which, in most cases, is the government. Because doctors are freed from suits, doctors in other countries do not need to have excessive procedures done just to cover themselves.
What Americans are giving up is their right to sue, while gaining almost no reduction in insurance premiums. The Congressional Budget Office estimates tort reform will save only about $3 billion a year out of $3 trillion in yearly medical costs.
